{"id":1881,"date":"2012-02-09T00:30:37","date_gmt":"2012-02-09T05:30:37","guid":{"rendered":"http:\/\/www.musicbymailcanada.com\/blog\/?p=1881"},"modified":"2012-02-09T00:30:37","modified_gmt":"2012-02-09T05:30:37","slug":"riaa-responds-to-protests","status":"publish","type":"post","link":"https:\/\/www.musicbymailcanada.com\/blog\/?p=1881","title":{"rendered":"RIAA Responds To Protests"},"content":{"rendered":"<p>Well, a <strong>RIAA<\/strong> spokesperson had responded to the <strong>SOPA<\/strong> and <strong>PIPA<\/strong> protests in the <a href=\"http:\/\/www.nytimes.com\/2012\/02\/08\/opinion\/what-wikipedia-wont-tell-you.html\">NY Times<\/a>. And of course, it&#8217;s the same old rhetoric.<\/p>\n<p>Apparently he thinks everyone that opposed the <strong>Stop Online Piracy Act<\/strong> and <strong>Protect IP Act<\/strong> were either severely misinformed or want everything for free.<\/p>\n<p>Of course <strong>RIAA<\/strong> are doing their best to &#8220;<em>inform<\/em>&#8221; people of their spin, that the industry is suffering. And by &#8220;<em>inform<\/em>&#8221; I mean <strong>suing Americans<\/strong> and <strong>foreigners<\/strong> willy nilly. But it is obvious that the public is not buying their claims.<\/p>\n<p>For two decades every expert in the industry has stated the music industry would shift from <strong>physical<\/strong> formats to <strong>digital<\/strong>. But they resisted, to their detriment, and wish to continue resisting even when <a href=\"http:\/\/www.docstoc.com\/docs\/111579571\/TheSkyIsRisingReport\" target=\"_blank\">international music sales are growing substantially<\/a>.<\/p>\n<p>It&#8217;s obvious that they&#8217;re crying foul on behalf of the manufacturers, who will be unable to capitalize on <strong>format shifts<\/strong> in the past. <\/p>\n<p>These manufacturers, many of which are owned by the labels, profited from <strong>format shifting<\/strong>, when people upgraded from <strong>vinyl<\/strong> to <strong>8-track<\/strong>, from <strong>8-track<\/strong> to <strong>cassette<\/strong> and from <strong>cassette<\/strong> to <strong>CD<\/strong>. And if they had their way they&#8217;d get a royalty whenever someone copies a recording to a device.<\/p>\n<p>This is an industry that thinks that because you aren&#8217;t paying to copy your <strong>legally purchased mp3s<\/strong> to your <strong>mp3 player<\/strong> that you are a &#8220;thief&#8221;. That you are just like those pirates that mass produce <strong>CDs<\/strong> and <strong>DVDs<\/strong> and sell them in pawn shops, farmer&#8217;s markets and online.<\/p>\n<p>No ? Then why are these people lobbying the current government in Canada to disallow <strong>private copying<\/strong> of copy protected works with <strong>Bill C-11<\/strong> ? Why are attempting to push a levy <strong>mp3 players<\/strong> in Canada ?<\/p>\n<p>We&#8217;ve heard the excuse that some people use the internet to download <strong>mp3<\/strong> files illegally. But have they ever produced a study proving the majority of these illegally downloaded recordings end up on <strong>mp3 players<\/strong> ? <\/p>\n<p>Of course not. <\/p>\n<p>They don&#8217;t want to distinguish <strong>previewing<\/strong> and <strong>private copying<\/strong> from <strong>illegal downloads<\/strong>. They&#8217;d rather just use one word, &#8220;<em><strong>infringement<\/strong><\/em>&#8220;, to gloss over the issues and call pretty much everything <strong>piracy<\/strong> to get their way with the technologically inept politicians.<\/p>\n<p>Some members of the industry are also <a href=\"http:\/\/www.scc-csc.gc.ca\/case-dossier\/cms-sgd\/dock-regi-eng.aspx?cas=33800\" target=\"_blank\">currently attempting<\/a> to obtain royalties for the <strong>30 second previews<\/strong> retailers posts online in Canada, in order to disqualify music downloads as &#8220;<strong>fair dealing<\/strong>&#8221; research for Canadians. <\/p>\n<p>The <strong>Stop Online Piracy Act<\/strong>, <strong>Protect IP Act<\/strong> and <strong>Anti-Counterfeiting Trade Agreement<\/strong> impose <strong>RIAA<\/strong>&#8216;s views in regards to <strong>fair dealing<\/strong> and <strong>private copying<\/strong> on foreign nations.<\/p>\n<p>They circumvent the <strong>democratic processes<\/strong> of nations who have established their own legislation on these subjects and an undue influence in regards to policy is imposed on nations that are undergoing <strong>copyright reforms<\/strong>.<\/p>\n<p>It is obvious that the inflexibility of <strong>ATCA<\/strong> in regards to <strong>fair dealing<\/strong> and <strong>copy protection<\/strong> is causing the current government in Canada to refuse to alter <a href=\"http:\/\/www.parl.gc.ca\/HousePublications\/Publication.aspx?Docid=5144516&#038;File=9\" target=\"_blank\">Bill C-11<\/a> in accordance to the public&#8217;s wishes.<\/p>\n<p>This proves that our political process has been polluted by <strong>foreign interests<\/strong> and <a href=\"http:\/\/rt.com\/usa\/news\/senate-sopa-new-internet-847\/\" target=\"_blank\">SOPA\/Protect IP like legislation<\/a> in the <strong>United States<\/strong> could further undermine <strong>Canada&#8217;s democracy and sovereignty<\/strong>.<\/p>\n<p>When <strong>Bill C-11<\/strong> was introduced as <strong>Bill C-32<\/strong>, the <a href=\"http:\/\/www.cba.org\/cba\/submissions\/pdf\/11-06-eng.pdf\" target=\"_blank\">Canadian Bar Association<\/a> openly questioned the workability and purpose of some of the provisions, including the <strong>fair dealing<\/strong> and <strong>technological protection measure<\/strong> provisions. <\/p>\n<p>They also questioned the need for additional legislation to address unauthorized distribution on the internet, so there is clearly a disconnect in-between the <a href=\"http:\/\/www.ic.gc.ca\/eic\/site\/008.nsf\/eng\/h_00001.html\" target=\"_blank\">people of Canada<\/a> and the legislation&#8217;s proponents. <\/p>\n<p>This is clearly the case in the <strong>United States<\/strong> as well.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Well, a RIAA spokesperson had responded to the SOPA and PIPA protests in the NY Times.
