{"id":1903,"date":"2012-02-11T05:00:10","date_gmt":"2012-02-11T10:00:10","guid":{"rendered":"http:\/\/www.musicbymailcanada.com\/blog\/?p=1903"},"modified":"2012-02-11T05:00:10","modified_gmt":"2012-02-11T10:00:10","slug":"new-blank-audio-media-levy-proposed","status":"publish","type":"post","link":"https:\/\/www.musicbymailcanada.com\/blog\/?p=1903","title":{"rendered":"New Blank Audio Media Tariffs Proposed"},"content":{"rendered":"<p>The <strong>blank audio media tariffs<\/strong> proposed for 2014 were published in today&#8217;s <a href=\"http:\/\/www.cb-cda.gc.ca\/tariffs-tarifs\/proposed-proposes\/2014\/SCPCP.pdf\" target=\"_blank\">Canada Gazette<\/a> and are as follows :  <\/p>\n<ul>\n<li><strong>29 cents<\/strong> per <strong>recordable compact disc<\/strong> (CD-R, CD-RW, CD-R Audio, CD-RW Audio)<\/li>\n<li><strong>50 cents<\/strong> per <strong>microSD memory card<\/strong> with <strong>1 gigabyte of memory or less<\/strong><\/li>\n<li><strong>1 dollar<\/strong> per <strong>microSD memory card<\/strong> with <strong>more that 1 gigabyte of memory but less than 8 gigabyte of memory<\/strong><\/li>\n<li><strong>3 dollars<\/strong> per <strong>microSD memory card<\/strong> with <strong>more than 8 gigabytes of memory<\/strong><\/li>\n<\/ul>\n<p>Of course the question remains on whether <strong>microSD memory cards<\/strong> are &#8220;<em><strong>ordinarily used by individual consumers<\/strong><\/em>&#8221; as an &#8220;<em><strong>audio recording medium<\/strong><\/em>&#8220;, as defined by <a href=\"http:\/\/laws-lois.justice.gc.ca\/eng\/acts\/C-42\/page-54.html#h-66\" target=\"_blank\">Part VIII, Section 79<\/a> of our <strong>Copyright Act<\/strong>.<\/p>\n<p>Personally I have yet to use these cards or any other non-embedded memory card for anything but <strong>photography<\/strong> and <strong>video<\/strong>. And I also know several individuals who use these cards in their <strong>netbooks<\/strong> as a storage medium for their documents. So I have serious doubts in regards to the claim that these <strong>memory cards<\/strong> qualify as &#8220;<strong><em>blank audio recording media<\/em><\/strong>&#8220;, especially those of a higher class.<\/p>\n<p>I use <strong>class 10 SDHC memory cards<\/strong> for my <strong>high definition photography<\/strong> and <strong>videos<\/strong>, which are considerably more expensive than <strong>class 2 SD memory cards<\/strong>. And the latter is quite adequate for the recording and playback of 254 kbps music files.<\/p>\n<p>According to the <strong>SD Association<\/strong>, <strong>MicroSD memory cards<\/strong> were manufactured for the <strong>mobile phone<\/strong> market. And though most <strong>mobile phones<\/strong> now record video in <strong>HD<\/strong>, a higher class of <strong>memory card<\/strong> is unnecessary for the playback of music on those devices.<\/p>\n<p>Furthermore, <strong>mobile phones<\/strong> that include these <strong>memory cards<\/strong> at the time of purchase may contain <strong>ring tones<\/strong>, software and\/or other data, which disqualify these cards as &#8220;<strong>blank<\/strong>&#8220;.<\/p>\n<p>I suspect many <strong>memory card<\/strong> manufacturers and retailers will file their objections to these proposed tariffs, as they did in the past.
