{"id":1919,"date":"2012-02-16T00:05:29","date_gmt":"2012-02-16T05:05:29","guid":{"rendered":"http:\/\/www.musicbymailcanada.com\/blog\/?p=1919"},"modified":"2012-02-16T00:05:29","modified_gmt":"2012-02-16T05:05:29","slug":"we-will-entertain-amendments","status":"publish","type":"post","link":"https:\/\/www.musicbymailcanada.com\/blog\/?p=1919","title":{"rendered":"&#8220;We Will Entertain Amendments&#8221;"},"content":{"rendered":"<p>In response to concerns about <strong>privacy<\/strong> and <strong>judicial oversight<\/strong>, the Conservative government has stated that they would be open to amendments to <a href=\"http:\/\/www.parl.gc.ca\/HousePublications\/Publication.aspx?Language=E&#038;Mode=1&#038;DocId=5380965&#038;File=32#1\" target=\"_blank\">Bill C-30<\/a> in committee.<\/p>\n<p>Cited as the <strong><em>Investigating and Preventing Criminal Electronic Communications Act<\/em><\/strong>, this bill enables the <strong>RCMP<\/strong>, <strong>Canadian Security Intelligence Service<\/strong>, <strong>Commissioner of Competition<\/strong> and <strong>police services<\/strong> through-out Canada access to subscriber information without warrants whilst investigating offenses under their mandate.<\/p>\n<p>On March 9th, 2011, a <a href=\"http:\/\/www.priv.gc.ca\/media\/nr-c\/2011\/let_110309_e.cfm\" target=\"_blank\">joint statement<\/a> by the <strong>federal and provincial privacy commissioners of Canada<\/strong> was issued in response to the previous proposed legislation. And the concerns listed in that statement and in the October 26th, 2011 <a href=\"http:\/\/www.priv.gc.ca\/media\/nr-c\/2011\/let_111027_e.cfm#contenttop\" target=\"_blank\">statement<\/a> issued by the <strong>Office of The Privacy Commissioner of Canada<\/strong> remain with <strong>Bill C-30<\/strong>.<\/p>\n<p>Unfortunately there is also some concern in regards to the interpretation of evidence and preconceptions related to certain activities, like the use of <strong>peer to peer services<\/strong> or file services like <strong>Megaupload<\/strong>.<\/p>\n<p>Yes, <strong>peer to peer programs<\/strong> are being used for illegal activities, as did <strong>Megaupload<\/strong>. But does it mean that all activity on these services are suspicious, requiring the collection of information from the users of these services ?<\/p>\n<p><strong>Section 16, subsection (2)(b)<\/strong> may also enable <strong>foreign police services<\/strong> to access this information, which could then be subject to their local laws and their inherent weaknesses. <\/p>\n<p>Groups like <strong>Anonymous<\/strong> have been able to hack into many of the aforementioned police services so how secure will the information be ? And what&#8217;s to stop criminals from abusing <strong>section 17<\/strong>, which compels internet and cell phone providers to give private information to any police officer upon receipt of an <em><strong>oral<\/strong><\/em> request ?<\/p>\n<p>Hopefully these issues will be addressed with much more than the <strong>false dichotomy<\/strong> Canadians have been subjected to lately.  <\/p>\n","protected":false},"excerpt":{"rendered":"<p>In response to concerns about privacy and judicial oversight, the Conservative government has stated that they would be open to amendments to Bill C-30 in committee.
